Resumen

Metodología de la ciencia jurídica (europeo-continental).

Objetivos de investigación, preguntas y métodos

El objetivo fundamental del artículo es exponer un marco metodológico más elaborado y riguroso de la ciencia jurídica, basado en las aportaciones de la teoría analítica del derecho contemporánea. El artículo se centra en cinco objetivos clave de la investigación jurídico-científica: describir el derecho, explicar el derecho, evaluar el derecho, recomendar un mejor derecho y una mejor interpretación y aplicación del derecho, y sistematizar el derecho. Expone estos objetivos y, para cada uno de ellos formula posibles preguntas e hipótesis de investigación,  y describe los métodos apropiados para contrastar las hipótesis. El artículo también muestra que la teoría analítica del derecho, como laboratorio conceptual y como meta-ciencia jurídica, constituye en gran medida la metodología de la ciencia jurídica.
