Responsive Judicial Review and J.H. Ely in the “Bed of Procrustes”

Control judicial sensible o receptivo y J. H. Ely en el “lecho de Procusto”
El control judicial ha permitido a las minorías articular sus demandas en un lenguaje constitucional y ha obligado a las mayorías a debatir los méritos de dichas demandas. Para abordar las amenazas actuales a la capacidad de respuesta democrática, el modelo de control judicial de Dixon se basa en el proceso político de Ely, centrado en mejorar los procedimientos y reforzar la representación política. No me interesa cuestionar el enfoque actualizado de Ely para justificar formas débiles o fuertes de control judicial, sino explorar su potencial para proporcionar la base normativa de una versión sensible o receptiva del control judicial que las democracias del Sur Global realmente necesitan. Independientemente de los casos y ejemplos del Sur Global bien considerados —una rareza encomiable en la literatura parroquial del Norte Global—, el modelo de Dixon no caracteriza adecuadamente ni justifica normativamente una forma excepcionalmente activista de revisión judicial capaz de abordar problemas estructurales. En democracias con profundas disfunciones, la justificación del control judicial se basa en fallas sistémicas de las políticas públicas, falta de coordinación institucional, insuficiencia presupuestaria crónica y prolongada incapacidad de las autoridades para adoptar las medidas necesarias. La metáfora del “lecho de Procusto” ilustra el proceso de poner a prueba la aplicabilidad de un modelo en el Sur Global, tal como pretende Dixon con el enfoque normativo, pero minimalista, de Ely respecto al control judicial. El potencial predictivo y explicativo de las teorías políticas y constitucionales para comprender y resolver problemas depende en gran medida de singularidades políticas y sociales, así como de la historia constitucional.
