Resumen

Este ensayo examina Responsive Judicial Review - Democracy and Dysfunction in the Modern Age, el último libro de Rosalind Dixon. Dixon elabora una defensa de la intervención judicial frente a tres tipos de disfunciones democráticas: la monopolización del poder político, los “puntos ciegos” del legislador y las “cargas de inercia” que obstaculizan la respuesta institucional a las demandas sociales. Incorpora criterios sobre la construcción de autoridad y la calibración de las acciones judiciales. Su concepción permite justificar democráticamente la intervención judicial en la protección gradual de los derechos sociales. Los autores se concentran en el problema de las cargas de inercia y argumentan que la ausencia de consenso político (frecuente en sociedades polarizadas) eleva los costos y riesgos de la acción judicial. El ensayo propone distinguir distintos niveles de consenso: (1) sobre la existencia del problema, (2) sobre el rechazo de la política vigente y (3) sobre la política futura a adoptar. Un consenso a nivel 1 no implica consenso a nivel 2, y así sucesivamente. Identificar el tipo de consenso puede ayudar a comprender el contexto decisional y la viabilidad de los remedios judiciales. Aunque Dixon está consciente de que las sentencias pueden, paradójicamente, reforzar la inercia existente y desencadenar otros problemas, los autores también argumentan que dichas consecuencias podrían debilitar la defensa normativa de la judicialización en ámbitos de política pública menos vinculados al núcleo básico de la democracia.
