Personal or Contextual Vulnerability? Approaches to the Analysis of Law from a Gender Perspective
The paper develops a critique and a proposal for the use of the qualification of vulnerable from a gender perspective. Based on a critical analysis of the concept of classical autonomy, the notion of relational autonomy is defended as being scientifically more fruitful, more apt to explain the real human actions of non-idealized people, and capable of accounting for relatively constrained actions. From this perspective, a number of adjudication cases is approached where the qualification of vulnerability, applied in context, is useful to identify legal space for damage towards women or minorities.
