Abstract

Constituye ya un lugar común en la discusión iusfilosófica actual que los “precedentes” ocupan una posición muy destacada entre los argumentos de que dispone el juez para justificar sus decisiones, tanto si hablamos del sistema de derecho continental o codificado, como si nos referimos al sistema del common-law.
