Abstract

En nuestra cultura jurídica se requiere, como condición de buen ejercicio de la función de administrar justicia, que las decisiones de los jueces sean fundadas en derecho. Este requisito suele expresarse diciendo que la decisión debe constituir una “derivación razonada del derecho vigente.
