La aplicabilidad del programa falsacionista de Popper a la ciencia jurídica
Abstract
Resulta extraño, en cambio, que no haya recibido aplicación alguna en el derecho el método de Popper. Determinadas proposiciones acerca de ciertas normas (de una decisión judicial, por ejemplo) son capaces de ser refutadas (falsadas) por los hechos. La teoría general del derecho ha desperdiciado hasta ahora este criterio, pese a ser potencialmente fructífero.
