La idea de que las decisiones judiciales son obligatorias no sólo para las partes no es nueva. De hecho, hubo un tiempo en que éstas constituían el único derecho. Por ello, los rasgos distintivos del derecho (dikaion, ius, Reth), i.e. sus características definitorias, fueron sólo perceptibles como creación judicial.
