Abstract

A problem can be old because it is persistent, because we lack an adequate answer to it. Or it can be old because it is recurrent, because it reappears as soon as the conditions that made its solution possible in the past are eliminated. And a problem is new when it is the result of unexplored or newly encountered challenges. Terrorism and the rule of law is an old, recurrent problem. The relevance of neurological investigations for the concept of responsibility is an old, persistent problem, as is the international erosion of institutional structures. Clarifying the relations between ethics, politics and law by way of analytical philosophy is a new problem. Tackling these old and new problems in the philosophy of law from an analytical perspective, in the context of Latin America, is doubly difficult.
