Résumé

Positivisme juridique normatif : de la métaphysique à la politique

Cet article prend comme point de départ le livre Positivismo jurídico “interno”, de María Cristina Redondo, et propose une conception alternative du positivisme juridique normativiste. L'article soutient que la théorie juridique peut être neutre dans la mesure où elle est intersubjective et transparente quant à ses propres prémisses métaphysiques. Les objectifs de cet article sont donc, d'une part, de mettre en lumière le rôle de la métaphysique et du sens commun dans la construction du concept de droit ; d'autre part, de rendre plus transparents les choix éthico-politiques qui constituent les discours juridiques, y compris les discours théoriques. L'article analyse la thèse de Redondo sur la distinction entre ontologie et épistémologie et la possibilité d'une connaissance objective : l'idée centrale défendue est que l'inter-subjectivité, et non l'objectivité, devrait être le critère approprié pour le positivisme juridique normativiste. Le rôle de la normativité dans le positivisme juridique normativiste est ensuite examiné, en se concentrant sur la nature métaphysique de la thèse selon laquelle le droit appartient aux domaines de la normativité et de la raison pratique. Les sections ultérieures examinent les conceptions réductionnistes et antiréductionnistes des "entités" juridiques (normes, énoncés normatifs, propositions et croyances) et la théorie des sources du droit. La dernière section aborde la question de la neutralité de la théorie juridique en termes de valeurs et discute de la possibilité de décrire le point de vue interne des participants sans s'engager dans la pratique juridique existante.
