Abstract

Costituzionalismo deliberativo e controllo giurisdizionale. Un approccio sistemico

Il costituzionalismo deliberativo è un campo emergente che combina la teoria costituzionale – e il suo accento sui limiti  al potere politico – con la teoria democratica deliberativa – e la sua idea della deliberazione politica come fonte di legittimità democratica. Questa combinazione crea un nuovo quadro per affrontare le questioni di legittimità che sorgono nelle democrazie costituzionali. L'articolo contribuisce a quest'area di ricerca in crescita esplorando il suo potenziale per affrontare la legittimità del controllo giurisdizionale. In primo luogo, l'articolo sostiene che questo potenziale risiede nell'integrazione della teoria costituzionale con un approccio sistemico alla democrazia deliberativa e l'idea di un sistema deliberativo multilivello. In secondo luogo, l'articolo si basa su questa integrazione per spiegare la legittimità del controllo giurisdizionale come un'istituzione integrata in – e plasmata da – un sistema deliberativo e rappresentativo.
